ACCEPTABLE USE

COSI ACCEPTABLE USE POLICY

ACCEPTABLE USE POLICY – (additions, modifications, etc.,
published periodically and are hereby incorporated into this document
and all written and oral agreements at the discretion of COSI.
Resellers of COSI services are expected to uphold these policies with
their End-User Customers.)

OVERALL POLICY

While using the service, you may not:

* 1.Restrict or inhibit any other user from using and enjoying the Internet;

* 2.Post or transmit any unlawful, threatening, abusive, libelous, defamatory,
obscene, offensive, indecent, pornographic, profane, or otherwise objectionable
information of any kind, including without limitation any transmissions
constituting or encouraging conduct that would constitute a criminal offense,
give rise to civil liability, or otherwise violate any local, state, federal
or international law, including without limitation the U.S. export control
laws and regulations, and laws protecting intellectual property including copyright,
trademark, trade secret, misappropriation and anti-dilution laws;

* 3.Post, publish, transmit, reproduce or distribute any information or
software which contains a virus or other harmful component;

* 4.Post, publish, transmit, reproduce, distribute or in any way exploit any
information, software, or other material obtained through the service for commercial
purposes (other than as expressly permitted by the provider of such
information, software, or other material);

INTELLECTUAL PROPERTY POLICY

Use of COSI services to engage in any type of fraud, “cracking”, malicious behavior,
or harassment is expressly forbidden. Interference with the proper operation of
systems reachable via the Internet is forbidden. Compliance with the acceptable
use policies of any network or system with which you connect through our service
is required. Forging e-mail, Usenet postings, or other messages is forbidden.
Trafficking in pirated software is forbidden. Port scanning or the use of similar
tools is forbidden.

Use of COSI services to publish or otherwise disseminate information about
the availability of pirated software or other material that is being made available
illegally, including the publication of a list of links to such material,
regardless of disclaimers, is specifically forbidden. We do not condone or encourage
any illegal material or behavior.

If inappropriate activity is detected, all accounts of the user in question
will be deactivated until the investigation is complete. Prior notification to the
user is not assured. In extreme cases, law enforcement will be contacting
regarding the activity.

UNSOLICITED EMAIL / ADVERTISING / NEWS POLICY

The transmission of unsolicited or prohibited advertising or other content
through electronic mail or inappropriate Usenet postings is forbidden. The use
of COSI for unsolicited mass mailings or postings (commonly known as “Spam[TM]”)
by any customer will cause that customer’s services to be terminated immediately
and without warning, and the customer will be held legally responsible for the
damages to COSI, both monetary and in reputation. The use of any other service
to make such a mailing or posting, with any reference to COSI services
(including but not limited to mailboxes, autoresponders, and Web pages), shall
also be grounds for account termination as described in this document.

COSI’ services may only be used for lawful purposes. Any use of these services
which violates any local, state, federal, or international laws which may
apply to COSI, your local jurisdiction, or any jurisdiction that you or your
site may be subject to is strictly prohibited.

DOMAIN NAME POLICY

* 1.For all domains hosted at COSI, the “Technical Contact” must list COSI, or a
staff member thereof, in association with the domain records at the authoritative NIC.

* 2.For all domains, the nameservers must be selected and approved by COSI, including
all secondaries. Secondary nameservice is not shared with a third party
except by special pre-arrangement.

* 3.The use of any particular secondary nameserver by COSI does not imply
any official affiliation with the organization responsible for that nameserver.

* 4.COSI reserves the right to change nameservers when necessary, although
this is by no means a frequent occurrence.

* 5.COSI reserves the right to refuse to host, register, or support domain
names that it finds offensive or libelous. Judgement of what constitutes “offensive”
or “libelous” shall be at the sole discretion of COSI.

* 6.COSI makes no attempt to exercise control over its customers’ domains,
and will not make modifications to administrative, billing, organization, or other
associated records, without prior permission, except in cases of emergency or
violation of this policy.

* 7.All domains registered with COSI’s nameservers must appear in our nameserver
and billing records, and must be used for either “virtual hosting” or “parked”
(sharing an existing virtual host). Charges for these services are $25 setup
and $1/month, and $10 setup, respectively.

* 8.Any domain registered with COSI’s nameservers must be submitted as part of a
signup request, or submitted as an upgrade request, within 30 days of its registration
at the authoritative NIC. Domains registered but not submitted will be subject to
a $50 Lame Delegation Fee, which must be paid before “virtual hosting” or
“parked” services can be set up (with their own charges, as well). Waiver or
reduction of this fee shall be at the sole discretion of COSI. In cases where this
fee is applied, but remains unpaid by the billing due date, we will submit a “Delete”
or “On Hold” request to the authoritative NIC, removing our nameservers and suspending
the domain. We reserve the right to take other actions as necessary.

* 9.Registering any domain to our nameservers without the intent of paying our fees or
InterNIC’s fees is expressly prohibited. Registering multiple domains with no intent of
using those domains for service is forbidden. Anyone found to be “warehousing” domain
names for resale or not in “good faith” will have their services terminated at
our discretion, and we may contact InterNIC and advise them of the situation.

* 10.The use of any domain name that is considered offensive, defamatory, libelous
or violative of any local, state, federal or international law including any violation
of intellectual property, copyright, trademark, trade secret, misappropriation and
anti-dilution laws is strictly prohibited. It is the sole responsibility of the domain
name owner to take all steps necessary to ensure that the domain name selected
is not violative of any law or any other party’s rights.

* 11.You agree to indemnify, defend and hold harmless COSI from any and all liability,
penalties, losses, damages, costs, expenses, attorneys’ fees, causes of action or
claims caused by or resulting from your registration, acquisition or use of a domain
name which damages either you, COSI or any other party or parties, without
limitation or exception.

* 12.COSI reserves the right to arbitrarily and without prior notice withdraw the
usage of any “vanity domain” ending in .cosimo.com, cosimo.net,
or any other COSI owned domain if, in its sole discretion, the content or presentation
of the site is detrimental to or inappropriate for COSI due to the appearance
of .cosimo.com, cosimo.net, or other COSI owned domain name in the site name.

Examples include any site that attempts to represent itself as an official COSI site,
sites promoting adult material, sites promoting questionable business opportunities, etc.
